Terms of Service

These Terms of Service ("Terms") govern your access to and use of [SERVICE NAME] (the "Service"), an adult, artificial-intelligence creative platform operated by [COMPANY LEGAL NAME] s.r.o. (the "Company", "we", "us"), a company registered in the Slovak Republic with registered seat at [REGISTERED SEAT ADDRESS, SLOVAKIA], company ID (IČO) [IČO], VAT ID (IČ DPH) [IČ DPH], and reachable at aip.paksionline.com.
The Service lets you create and operate fictional AI characters and generate AI content with them (such as images), using the Service's AI features and third-party compute and AI providers, on a paid, credit-based model. By creating an account or using the Service you agree to these Terms. If you do not agree, do not use the Service.
The Service is intended strictly for adults. It is not available to anyone under 18 years of age. Please also read our Privacy Policy, which explains how we process personal data and forms part of these Terms.
1. Eligibility and age (18+)
The Service contains adult, sexually explicit material. You may use the Service only if you are at least 18 years old (or the age of majority in your jurisdiction, if higher) and it is lawful for you to access adult content where you are located.
By using the Service you represent and warrant that you meet these requirements. We operate age-assurance controls and may require you to complete age verification before you can create an account, make a payment, generate content, or access your private gallery. We may refuse, suspend, or terminate access if we cannot reasonably establish that you are an adult.
You are responsible for ensuring that your use of the Service complies with the laws applicable to you, including any local restrictions on adult content.
2. Accounts and security
You need an account to use the Service. You must provide accurate information, keep your credentials confidential, and are responsible for all activity under your account. Notify us promptly at the contact address below if you suspect unauthorised use.
Accounts are personal to you. You may not share, sell, or transfer your account, and you may not create an account on behalf of anyone else or using another person's identity.
3. The Service and your licence to use it
Subject to these Terms and to your maintaining sufficient credits and an active subscription where required, we grant you a limited, non-exclusive, non-transferable, revocable licence to use the Service for your own lawful, personal or professional creative purposes.
The Service relies on third-party compute and AI providers to train character models, generate images, and provide the Service's other AI features. Availability, processing time, and output quality depend in part on those providers and are not guaranteed. We may add, change, or discontinue features at any time.
4. Credits, subscriptions and top-ups
The Service runs on "credits", a platform-only unit of account used to pay for actions such as character training, image generation, and other AI features. Credits have no monetary value, are not electronic money or any form of currency, are not redeemable for cash, and are non-transferable. Prices, credit costs per action, and plan inclusions are shown in the Service and may change prospectively.
Two credit buckets
Your balance is made up of two distinct buckets: (a) subscription credits, granted as part of a recurring subscription plan; and (b) top-up credits, bought as one-time purchases. When you spend credits, subscription credits are used first.
Subscription credits reset each cycle
Subscription credits are granted for the current billing cycle and expire at the end of that cycle by design. On each renewal the subscription bucket is reset and re-granted. Unused subscription credits do not roll over and this is not a refundable event.
Cancellation is immediate — subscription credits are forfeited
If you cancel your subscription, the cancellation takes effect immediately: your subscription credit bucket is set to zero, with no refund and no prorated or residual credit for the unused part of the cycle. Please make sure you understand this before subscribing.
Top-up credits are locked, not deleted, if your subscription lapses
Top-up credits require an active subscription to be spent. If your subscription is cancelled or lapses, your previously purchased top-up credits are not deleted — they are locked (temporarily unusable) and are restored to spendable status when you resubscribe. In other words, you must remain subscribed for the lifetime of your top-up balance, or resubscribe to access it again.
12-month inactivity expiry
Top-up credits expire after 12 months of account inactivity. The inactivity countdown resets on each account activity — including signing in, generating content, training a character, purchasing a top-up, or any subscription action. Expired credits are forfeited and are not refundable.
5. Payment, billing and taxes
Payments are processed by third-party payment service providers. We do not receive or store your full card details. You authorise the applicable charge (subscription fee or one-time top-up) at the point of purchase, and you are responsible for keeping a valid payment method on file for recurring charges.
Prices are stated inclusive or exclusive of applicable taxes as indicated at checkout. Where we are required to charge VAT or other taxes, they will be added and shown before you confirm. You are responsible for any taxes that are your own legal obligation.
Recurring subscriptions renew automatically until cancelled. You can cancel at any time from your account; cancellation stops future renewals and takes effect as described in section 4.
6. Refunds and EU right of withdrawal
Credits are digital content supplied for immediate use. When you purchase credits or a subscription and ask us to make the Service available immediately, you expressly request that performance begins at once.
Under EU consumer law you normally have a 14-day right of withdrawal for digital purchases. By requesting immediate performance and acknowledging the consequence, you agree that you lose that right of withdrawal once the digital content has been supplied and you have begun to use it (for example, once credits are made available and any credit has been spent). To the extent credits remain entirely unused, we will honour a withdrawal request made within the statutory period where the law requires it.
Except where a refund is required by mandatory law: we do not refund on cancellation; subscription credits forfeited on cancellation are not refundable; previously purchased top-up credits are not deleted but are locked and retrievable on resubscription (subject to the 12-month inactivity expiry in section 4); and subscription credits that expire at the end of a cycle are not a refundable event.
Nothing in these Terms limits any non-waivable statutory rights you have as a consumer.
7. Acceptable Use Policy
The Service is for fictional, AI-generated adult content. You are solely responsible for the prompts you submit and the content you generate, and for ensuring that they are lawful under every law that applies to you — including the law of your own country, the law of the Slovak Republic, and the law of any place from which you access the Service. The categories below are examples of what is prohibited; they are not an exhaustive list. Breach may result in immediate termination and, where required by law, reporting to the competent authorities.
Absolutely prohibited content
- Any child sexual abuse material (CSAM), including AI-generated, virtual, simulated, or drawn material, and any sexual or sexualised depiction of a minor or of any person who is, or appears to be, under 18 years of age. Under Slovak Criminal Code (Act 300/2005) § 132(4), depictions of a person appearing to be a child and simulated depictions are treated as child pornography. There is zero tolerance: such content is criminal, will be blocked, may be preserved and reported to the competent Slovak authorities, and your account will be terminated.
- Content depicting, sexualising, or targeting real, identifiable people without their consent — including non-consensual intimate images, sexual deepfakes, face-swaps, or look-alikes of real individuals. The Service is for fictional characters only.
- Content depicting non-consensual sexual activity, sexual violence presented as real, trafficking, bestiality, incest, or other content prohibited by applicable law.
- Content that violates the rights of others (intellectual-property, privacy, publicity) or that is unlawful where you or your audience are located.
General prohibition
Beyond the specific examples above, you must not generate, request, store, or use any content that is unlawful, that infringes the rights of others, or that we are required to restrict under applicable law. Legal standards differ between countries: content permitted in one jurisdiction may be prohibited in another. As we make the Service available in additional countries, further restrictions may apply under local law, and we may block or remove content and impose additional rules to comply. You remain responsible at all times for complying with the laws that apply to you.
Prohibited conduct
- Attempting to bypass, disable, or probe age-assurance, safety, or moderation controls.
- Reverse-engineering, scraping, overloading, or interfering with the Service or its providers, or using automated means except as we expressly permit.
- Reselling, redistributing, or commercially exploiting the Service or generated outputs in violation of these Terms or third-party provider terms.
- Uploading malware, attempting unauthorised access, or using the Service to harass, defame, or harm others.
We may use automated and manual moderation, including detection tooling, to enforce this policy. See section 10.
8. Your content, ownership and privacy of generations
As between you and us, and subject to these Terms, third-party provider terms, and applicable law, you retain the rights you have in the characters, images, and other content you generate. You grant us the limited rights necessary to operate the Service — for example to store, process, transmit, back up, and display your content to you, and to process it through our compute and storage providers.
Your generated content and characters are private to your account. The Service does not provide a feature to publish, share publicly, or distribute your content to other users or to the public. You are responsible for your own use of any content you choose to export.
You represent that your content and your use of it comply with these Terms, the Acceptable Use Policy, and all applicable laws.
9. AI-generated content
All characters, images, and other outputs produced by the Service are artificial and fictional. They do not depict real people and are not photographs or recordings of real people or real events. Outputs may be inaccurate, unexpected, or not to your taste; generation is probabilistic and we do not guarantee any particular result.
You must not present AI-generated content as depicting a real, identifiable person, and you must comply with any applicable obligations to disclose that content is AI-generated.
10. Moderation, detection and reporting
To keep the Service lawful and safe, we operate technical and organisational measures to detect prohibited content, in particular CSAM. Where we detect, or are notified of, content or conduct that is, or appears to be, unlawful, we may block it, preserve relevant data as evidence, suspend or terminate the account, and report to the competent authorities.
As a provider established in the Slovak Republic, we report suspected child sexual abuse material to the competent Slovak authorities in accordance with Slovak law. We will cooperate with lawful requests from authorities. Our handling of personal data in this context is described in the Privacy Policy.
11. Suspension and termination
You may stop using the Service and close your account at any time. We may suspend or terminate your access immediately if you breach these Terms (in particular the Acceptable Use Policy), if required by law, or to protect the Service, other users, or third parties.
On termination, your licence to use the Service ends. Sections that by their nature should survive (including those on prohibited content, ownership, disclaimers, liability, and governing law) survive termination. Forfeiture of credits on termination for breach is governed by section 4 and applicable law.
12. Disclaimers and limitation of liability
The Service is provided "as is" and "as available". To the maximum extent permitted by law, we disclaim all implied warranties, including fitness for a particular purpose and uninterrupted or error-free operation. We are not responsible for the acts, omissions, or availability of third-party providers.
To the maximum extent permitted by law, our aggregate liability arising out of or relating to the Service is limited to the amount you paid to us for the Service in the 12 months before the event giving rise to the claim, and we are not liable for indirect, incidental, special, or consequential damages. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law (including liability for death or personal injury caused by negligence, or for fraud), nor any non-waivable consumer rights.
13. Indemnification
To the extent permitted by law, you agree to indemnify and hold us harmless from claims, damages, and reasonable expenses arising out of your breach of these Terms or the Acceptable Use Policy, or your misuse of the Service. This does not apply to the extent a claim results from our own wrongdoing or where the law does not permit such indemnification by a consumer.
14. Changes to the Service and to these Terms
We may update these Terms from time to time. When we do, we will post the updated Terms with a new effective date and, for material changes, take reasonable steps to notify you (for example by email or an in-product notice). Changes take effect on the stated effective date. Your continued use of the Service after that date constitutes acceptance; if you do not agree, you should stop using the Service and may close your account.
Where a change materially affects an active paid subscription (for example a price change, or a material change to what your plan includes), we will notify you and the change will apply from your next billing cycle, so that you can cancel before it takes effect if you do not agree.
15. Governing law and jurisdiction
These Terms are governed by the laws of the Slovak Republic, without regard to conflict-of-laws rules. The courts of the Slovak Republic have jurisdiction over disputes arising out of or relating to these Terms or the Service. If you are a consumer resident in the EU, you also benefit from any mandatory protections of the law of your country of residence, and you may use the EU Online Dispute Resolution platform.
